North Landscape Contractors – Terms & Warranty Policy

At North Landscape Contractors, we take pride in the quality of our work and materials.
We are pleased to offer the following warranty terms to ensure your satisfaction and to protect your investment.
 

North Landscape Contractors – Terms and Conditions
 
“Pricing submitted with all work being completed by North Landscape Contractors.”
 
Terms:
 
Payment Schedule
  1. Commercial Projects: Invoices due for partial or progress payments on projects 2 weeks or longer duration.
  • Residential Projects: 25% deposit due upon project committal.
  • Progress draws required on projects exceeding two weeks in duration.
  • Balance due upon completion.
  • A 2% monthly interest charge applies to overdue accounts.
 
2. Use of Subcontractors
  • North Landscape Contractors reserves the right to use subcontractors for any and all services and projects.
 
3. Soil Conditions
  • All proposals are based on the assumption of normal soil conditions unless otherwise stated.
 
4. Foundation Water Leaks
  • North Landscape Contractors is not responsible for water leaks caused by ground disturbance near foundations.
 
5. Driveways and Paved Surfaces
  • A minimum 2% slope is required to prevent water pooling.
  • If a 2% grade is not feasible due to site constraints, North Landscape Contractors is not responsible for puddling or pooling water.
 
6. Obstruction Charges
  • Additional charges at an hourly rate will apply if unexpected rock or debris impede timely progress (e.g., during post or footing excavation).
 
7. Final Invoicing
  • The final invoice will reflect actual installed quantities.
 
8. Warranty Policy

  • Warranty work will be scheduled for August and September following the 12-month period from completion.
 
9. Estimate Approval
  • All estimates are subject to final review and approval by North Landscape Contractors' head office prior to project commencement.
 
10. Material Pricing and Availability
  • Pricing is based on current material costs and availability.
  • North Landscape Contractors reserves the right to adjust quoted pricing in the event of supply shortages or material price increases.
 
11. Tree Roots and Future Movement
  • Visible roots will be removed during excavation.
  • North Landscape Contractors is not liable for future movement in patios, fences, or retaining walls caused by unseen or future root growth.
  • Excessive root issues may result in additional charges.
 
12. Existing Asphalt Conditions
  • While reasonable precautions will be taken, North Landscape Contractors is not responsible for damage to aging or compromised asphalt during the course of work.
 
13. Changes and Extras
  • Any approved changes or alterations to the signed quotation will be invoiced immediately as extras, with payment due upon receipt.
14.  Municipal Compliance and Site Conditions
  • Regulatory Standards
    Contractor will perform the Work in accordance with generally accepted industry practices and applicable building codes to the extent reasonably possible. Contractor does not guarantee compliance with municipal regulations that are not provided in writing prior to commencement of the Work or that are impractical to achieve given existing site conditions.
  • Site Limitations
    Client acknowledges that physical characteristics of the property (including but not limited to grade, soil stability, access, and neighboring structures) may limit the ability to meet certain municipal or regulatory requirements. Contractor shall not be held responsible for costs, delays, or modifications required by municipal authorities as a result of these inherent limitations.
  • Permits and Approvals
    Unless expressly stated otherwise, Client shall obtain and maintain all necessary permits, inspections, and approvals. Contractor’s scope does not include guaranteeing that the Work will be accepted by municipal authorities where acceptance is based on discretionary, arbitrary, or subjective criteria.
  • Unforeseen Regulatory Changes or Directives
    If, during or after construction, a municipal authority requires changes to the Work that were not reasonably foreseeable at the time of contract execution, such changes will be treated as a Change Order. Any additional costs or schedule adjustments shall be the responsibility of the Client.
  • Limitation of Liability
    Contractor shall not be liable for any indirect, consequential, or financial losses arising from municipal rejection of the Work, provided the Work was performed in accordance with industry standards and the agreed-upon design.
Errors and omissions excepted (E&OE).


 
Warranty Start Date: 
 
Coverage begins at substantial completion of the project. 
Payment Requirement:
All accounts must be paid in full for warranty obligations to be valid.
Accounts overdue beyond 60 days will forfeit all future warranty coverage. 
Non-Transferability:
Warranty is non-transferable.
If the property is sold, the warranty does not carry over to the new homeowner.
 
 
Plant Warranty:
Trees & Shrubs
Coverage: One (1) year, one-time replacement warranty.
Conditions:
Replacement includes the plant cost only; labour is billed separately at the current hourly rate.
Replacements are provided at the original installed size. Larger sizes may be requested at an additional cost.
Replanting of large trees may be limited by site access.
 
 
Perennials, Grasses & Groundcovers
No Warranty Provided:
These plants are highly susceptible to environmental stress during establishment.
Watering lapses or severe winters may negatively affect survival.
Mulching is recommended to conserve moisture and protect root systems.
 
Plant Warranty Exclusions & Limitations:
Plants installed without irrigation are not covered.
Transplanted material is not warranted.
Improper care, including underwatering, overwatering, or failure to follow a proper maintenance routine, voids the warranty.
Weed growth may occur in bulk triple mix soil; this is not a warrantable issue.
No coverage for plant failure due to extreme weather, pest infestations, or aesthetic dissatisfaction.
 
Exempt Plant Species (No Warranty Coverage)
Cedar Trees, Boxwood Shrubs, Rhododendrons, Azaleas
 
Hardscape Warranty:
Coverage Term:
Three (3) year limited warranty on all hardscape installations.
 
Typical Covered Issues:
Settling of pavers or base materials
Shifting or cracking of pavers, steps, or rocks
Damage from freeze/thaw cycles
 
 
Hardscape Warranty Limitations:
Natural product variation (colour, texture, grain, porosity) is not a defect.
Not covered: Staining, discolouration, efflorescence, cracking, chipping, or shape changes in wood.
Rust spots, hairline cracks in concrete, and mineral deposits are normal.
Use of salt, urea, or calcium for ice control voids warranty; use plain sand and plastic shovels only.
 
Not covered:
Plumbing leaks, sewer backups, insufficient waterproofing
Drainage system failures (e.g. clogged eavestroughs)
Sub-surface settlement near new foundations
Damage from power surges or improper reconfiguration of automation systems
Rodent/insect damage to wires or plumbing
Customer-supplied base work: Only the surface installation is warranted, not the underlying structure.
Homeowner alterations post-installation
 
Labour and Material: Included for valid hardscape warranty issues.
 
Woodwork Warranty
Coverage Term
Three (3) year limited warranty on all woodwork installations.
 
Coverage:
Unexpected material failure or workmanship defects.
 
Woodwork Limitations
Shrinkage, cracking, and knots are natural and expected in lumber.
Staining from organic debris or rusting metal on decking is not covered.
Lumber is hand-selected where possible to reduce imperfections.
 
Specialty Products Warranty:
 North Landscape Contractors does not assume responsibility for items with manufacturer or third-party warranties.
This includes (but is not limited to):
Appliances, pumps, barbecues, fireplaces, lighting systems
Pre-fabricated or client-supplied products
Fixtures and furniture
 
We will assist in facilitating manufacturer claims or subcontractor warranties
but will not be financially responsible for replacement or repair.
 
Subcontracted Work: 
Work supervised by North Landscape Contractors but performed by third-party specialists is covered
only under that subcontractor’s warranty.
Any extra costs related to such warranties will be the client's responsibility.
 
 
Client-Supplied Installers: 
No warranty is provided for work performed by the client or their contractors.
 
 
Warranty Service:
To initiate a warranty claim:
Contact our office with proof of project completion and a description of the issue.
We reserve the right to inspect and assess the reported issue before approving any warranty work.
